These terms apply whenever The Poultry Guy arranges transport for you. The Poultry Guy is a business based in Cape Town, South Africa, operated by Daniel as a sole proprietor ("we", "us", "our"). "You" means the business or person who asks us to arrange transport.
In plain terms: we find and book a checked, independent carrier for your load, acting on your behalf. The carrier moves your goods and is responsible for them in transit. You pay us one all-in price. The details are below.
1. Definitions
- Carrier: the independent transport operator who moves your goods.
- Goods: the cargo described in your request, quote and booking confirmation, including its packaging and pallets.
- Quote: our written price for a load, sent by email, WhatsApp or any other written means.
- Booking confirmation: our written confirmation that a carrier has been booked for your load on the terms of the accepted quote.
- Load: one consignment of goods from one pickup point to one delivery point, unless the quote states more stops.
2. Our role: we arrange transport as your agent
We act as your agent. On your behalf, we select a carrier, appoint them to transport your goods, and pass your requirements on to them. The carrier performs the transport and is solely responsible for it.
We coordinate the load and keep you informed, but we do not take possession of your goods and do not operate vehicles.
By accepting a quote, you authorise us to appoint a carrier and agree the terms of carriage with them on your behalf.
3. Quotes and bookings
- A quote is based on the information you give us. If the goods, size, weight, addresses, times or requirements turn out to be different, we may re-quote before collection.
- A quote depends on carrier availability until we send a booking confirmation. The booking confirmation is final.
- A quote is valid for the period stated on it, or for 3 days if no period is stated.
- If a quote, booking confirmation and these terms conflict, the booking confirmation applies first, then the quote, then these terms.
4. Prices and extras
- Our price is an all-in price for the load as quoted. It includes the carrier's charge and our fee. We don't have to show these separately.
- Unless the quote says otherwise, it includes transport, fuel and tolls for the quoted route, the vehicle type required, and reasonable loading and offloading time.
- Extras apply only if they are stated on the quote. These may include waiting time beyond the included time, cancellation after a carrier has been dispatched, additional stops, or changes you request after booking. They are charged at the rates stated on the quote.
- Prices are in South African rand. If we are registered for VAT, the quote will state whether VAT is included.
5. Payment
- New customers pay the full quoted price by EFT before collection. A carrier is dispatched once the funds have cleared.
- Account terms are available only by separate written agreement. Invoices on account are payable within the period agreed.
- If a payment is late, we may suspend further bookings until it's paid, and charge interest on the overdue amount at the rate prescribed under the Prescribed Rate of Interest Act, 1975, from the due date until payment.
- If you dispute part of an invoice, tell us in writing within 7 days of receiving it, and pay the undisputed part by the due date.
- Payment may not be withheld because an original proof of delivery document is missing, if delivery is shown by a copy, photo or other reasonable evidence.
6. Your responsibilities
You confirm that:
- you own the goods, or are authorised by the owner to arrange their transport on these terms;
- your description of the goods, including their nature, quantity, weight, value and temperature needs, is complete and correct;
- the goods are properly packed, labelled and ready for collection at the agreed time;
- the goods may legally be moved, and any documents that must travel with them are ready and provided to the driver;
- the pickup site is not under any veterinary quarantine or movement restriction that would prevent the goods from moving, and you'll tell us immediately if one applies;
- for chilled or frozen goods, the goods are at the required temperature when loaded. A refrigerated vehicle holds temperature; it is not designed to bring warm product down to temperature;
- loading and offloading will be arranged as agreed in the quote, and the carrier will have safe access to both sites.
You are responsible for costs and losses caused by incorrect information or by a breach of these confirmations.
7. Goods we do not arrange transport for
We do not arrange transport for live animals (including live birds), hazardous or dangerous goods, abnormal loads, poultry litter, manure or by-products, or any goods that are illegal to move. If such goods are handed to a carrier without our written agreement, you are responsible for all resulting costs, losses and claims.
8. Collection, delivery and delays
- Collection and delivery times are estimates unless a guaranteed time is agreed in writing in the booking confirmation.
- We'll tell you as soon as we know of any delay, and do what we reasonably can to minimise it, including finding a replacement carrier if one cancels.
- Delivery is complete when the goods are handed over at the delivery address and the delivery note is signed, or delivery is otherwise reasonably shown.
9. Responsibility for goods and our liability
- The carrier is responsible for your goods from loading until delivery. Every carrier we appoint must hold goods-in-transit insurance.
- Because we act as your agent, we are not liable for the acts or omissions of the carrier. Claims for loss of, damage to or delay of the goods lie against the carrier. We will help you pursue them.
- If, despite clause 2 of this section, we are found liable for any loss, our total liability for a load is limited to the lesser of: (a) the amount we actually recover from the carrier or its insurer for that loss, and (b) the price you paid us for that load.
- We are not liable for indirect or consequential loss, including loss of profit, sales, business or goodwill.
- Nothing in these terms limits liability that cannot legally be limited, including liability for fraud or for death or personal injury caused by negligence.
10. Claims
- Visible loss or damage must be noted on the delivery note at the time of delivery.
- Loss or damage that wasn't visible at delivery must be reported to us in writing within 3 days of delivery.
- Full claim details, including photos, quantities and values, must be sent to us within 30 days of delivery.
- If these steps aren't followed, the goods are treated as delivered complete and in good condition, unless you can show otherwise.
- We will pass your claim to the carrier and its insurer and follow it up on your behalf.
11. Insurance of your goods
Carriers' goods-in-transit insurance has limits and exclusions. We recommend that you insure your goods for their full value while in transit. We do not insure your goods unless we agree to arrange cover in writing.
12. Cancellations
You may cancel a booking without charge before a carrier has been dispatched, unless the quote says otherwise. Cancellation after dispatch is charged as stated on the quote.
13. Carriers introduced by us
We invest time in finding and checking carriers. For 12 months after a load, you agree not to book transport directly with a carrier we introduced to you, for the same or similar services, without going through us. If you do, you agree to pay us a commission of 10% of the amount you pay that carrier.
14. Events beyond anyone's control
Neither we nor you are liable for delay or failure caused by events beyond reasonable control. These include disease outbreaks and veterinary movement restrictions (including avian influenza control measures), strikes, protests, road closures, load-shedding, fuel shortages, severe weather, fire, flood, and acts of government. Payment obligations for work already done still apply.
15. Privacy
We handle personal information in line with our privacy policy. To arrange a load, we share the necessary contact and address details with the carrier, and share the carrier's name, vehicle registration and driver contact details with you.
16. Changes to these terms
We may update these terms. The version published on this page when you accept a quote applies to that load.
17. Law and disputes
- These terms are governed by the law of the Republic of South Africa.
- If a dispute arises, we'll both first try to resolve it in good faith.
- Either party may take a dispute to a competent court in the Western Cape. You consent to the jurisdiction of the magistrate's court for any claim, even if the amount would otherwise exceed that court's jurisdiction.
18. General
- These terms, the quote and the booking confirmation are the whole agreement for a load.
- If any part of these terms is unenforceable, the rest still applies.
- A delay in enforcing a right doesn't waive it.
